Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and FoodieMama ("FoodieMama," "we," "us," "our") and govern your access to and use of the FoodieMama mobile application and related services (the "Service"). FoodieMama is a curated food and travel guide that lets you browse a creator's restaurant, hotel, and street-food picks on a feed and map, save places, send reservation inquiries, write reviews and comments, and chat with an in-app AI concierge. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least the age of majority in your jurisdiction (or have verifiable consent from a parent or legal guardian) to use the Service. FoodieMama is not directed to children, and you may not use the Service if you are below the minimum age required by your jurisdiction. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.

2. Your account

You can create an account using email and password, Apple, or Google. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. The Service and curated content

The feed, map, recommendations, reservation-inquiry features, and AI concierge are provided for informational and convenience purposes. Curated picks reflect the opinions of the creator and FoodieMama and are not professional advice. Availability, pricing, hours, menus, and other details for any venue may change without notice; we do not control or guarantee the accuracy of third-party venue information. Reservation inquiries are requests only and do not constitute confirmed bookings. We may modify, suspend, or discontinue any part of the Service at any time.

4. AI concierge

The AI concierge generates responses using a third-party large language model (LLM) provider, to which the text of your messages is transmitted solely to generate a response. AI output may be inaccurate, incomplete, or out of date and should not be relied upon as professional, medical, legal, financial, or safety advice. Do not include sensitive personal information in concierge chat. You are responsible for independently verifying any information before acting on it.

5. User-generated content

The Service lets you submit content, including reviews, comments, reservation-inquiry notes, photos, and AI concierge messages ("User Content"). You retain ownership of your User Content.

By submitting User Content, you grant FoodieMama a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for formatting and display), publish, publicly display, and distribute that User Content for the purpose of operating, providing, promoting, and improving the Service. This license ends when you delete the User Content or your account, except (a) where it has been shared with others who have not deleted it, and (b) for reasonable backup copies retained for a limited period or as required by law.

You represent and warrant that you own or have all necessary rights to your User Content, including all rights in any photos and the consent of any identifiable people depicted, and that your User Content does not infringe any third party's intellectual property, privacy, or other rights. You are solely responsible for your User Content and the consequences of submitting it.

6. Prohibited content and conduct

You agree not to submit User Content or use the Service in any way that:

We may, but are not obligated to, review, moderate, remove, or disable access to any User Content at our discretion, and we may suspend or terminate accounts for violations.

7. Copyright and DMCA takedown procedure

FoodieMama respects intellectual property rights and responds to clear notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, send a written notice to our Designated Agent (below) that includes:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to be infringed;
  3. Identification of the material claimed to be infringing and information reasonably sufficient to let us locate it (e.g., a description and where it appears in the app);
  4. Your contact information (name, address, telephone number, and email);
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Upon receiving a valid notice, we will remove or disable access to the allegedly infringing material and may notify the user who posted it. If you believe your content was removed in error, you may submit a counter-notification containing the information required by the DMCA. We will terminate, in appropriate circumstances, the accounts of repeat infringers.

Note: To receive the DMCA safe-harbor protection, the Designated Agent must also be registered with the U.S. Copyright Office (copyright.gov, approx. $6 fee). Until a real physical address and registration are in place, this block is a placeholder.

8. Reporting illegal content (EU Digital Services Act)

FoodieMama hosts user-generated content — including reviews, comments, photos, and reservation inquiries — and therefore acts as a hosting service under the European Union's Digital Services Act (Regulation (EU) 2022/2065, the "DSA"). In line with the DSA's notice-and-action requirements, any user or third party (including in the EU) may notify us of content on the Service that they consider to be illegal or to infringe their intellectual property rights, and we will review and act on valid notices.

To submit a notice, email dmca@foodiemama.app (for copyright and other IP matters) or hello@foodiemama.app (for other illegal content). To help us assess and act on your notice, please include:

  1. A sufficiently substantiated explanation of why you consider the content to be illegal or infringing;
  2. A clear indication of the exact location of the content (for example, a description of the review, comment, photo, or inquiry and where it appears in the app);
  3. Your name and email address (except where the content concerns certain offences against minors, where contact details are not required); and
  4. A statement confirming your good-faith belief that the information in your notice is accurate and complete.

Upon receiving a notice, FoodieMama will review it in a timely, diligent, non-arbitrary, and objective manner. Where a notice is valid, we will act against the content — for example by removing or disabling access to it — and, without undue delay, we will notify both the person who submitted the notice and, where appropriate, the user who provided the content of our decision and the reasons for it, including how it may be contested. Notices that contain the elements above and concern alleged illegality will give us actual knowledge of that content for the purposes of the DSA. Copyright-specific notices may also be submitted under the DMCA procedure in Section 7.

This serves as FoodieMama's single point of contact for recipients of the Service and for authorities under the DSA. Communications may be submitted in English. Replace the placeholder address with a real one.

9. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not interfere with or disrupt the Service, circumvent any access controls, use automated means to access the Service without permission, or use the Service to violate the rights of others or any applicable law.

10. Intellectual property

The Service — including its software, design, text, graphics, logos, and curated editorial content (excluding User Content) — is owned by FoodieMama or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service except as expressly permitted.

11. Subscriptions and payments

FoodieMama is currently provided free of charge. We do not offer paid subscriptions or in-app purchases at this time. If we introduce paid features in the future, the price, billing cycle, and renewal terms will be clearly disclosed to you before you complete any purchase, and you will be able to manage or cancel any subscription through your Apple App Store or Google Play account settings, in accordance with that store's billing and cancellation policies. We will update these Terms before charging for any feature.

12. Third-party services and venues

The Service relies on third-party providers (for example, Google Firebase for authentication, database, and storage; Google Maps for map display; and an LLM provider for the AI concierge) and may reference or link to third-party venues, websites, or services. We are not responsible for the availability, content, accuracy, or practices of any third party, and your dealings with venues or other third parties are solely between you and them.

13. Disclaimers

THE SERVICE AND ALL CONTENT, INCLUDING CURATED PICKS, VENUE INFORMATION, AND AI CONCIERGE OUTPUT, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE. WE DO NOT WARRANT THE QUALITY, SAFETY, OR SUITABILITY OF ANY VENUE OR THE ACCURACY OF ANY RECOMMENDATION. YOU USE THE SERVICE AT YOUR OWN RISK.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOODIEMAMA AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY USER CONTENT, OR ANY VENUE OR THIRD PARTY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless FoodieMama from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

16. Termination

You may stop using the Service and delete your account at any time via Settings → Delete account in the app or as described on our Delete account page. We may suspend or terminate your access at any time if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including content license terms for already-shared content, disclaimers, limitation of liability, and indemnification) will survive.

17. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute, except where applicable law gives you the right to bring proceedings in your local courts. 18. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and where appropriate we will provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
